The Association shall have only one class of members, i.e. the owners of lots in Wildewood, a subdivision on the banks of Lake Palestine, situated in Henderson County, Texas. Each person purchasing a lot, whether by Deed or Contract of Sale, shall become a member of such Association known as the Wildewood Owners Association, Inc. The facilities belonging to the Wildewood Owners Association, Inc., including but not limited to the swimming pool, playground, boat launch, community center, volley-ball court, and tennis-court, shall be exclusively for the use of property owners and their temporary guests. A person shall not be considered a guest if he/she is merely leasing property in Wildewood Subdivision from a property owner unless the criteria is met as outlined in this section.
Lot owners may transfer their rights to use the facilities to any tenant to whom they are leasing. Lot owners must provide a copy of the lease to the Board of Directors and the lease must state that only the occupants of the residence have such right to use Association amenities. Such use is limited if they fail to comply with the governing documents for the Association (renters or owners). If a Lot owner chooses to transfer their rights to use the facilities to any tenant to whom they are leasing their Lot, that owner will not be allowed to use amenities until that tenant’s lease is expired. However, if the owner owns more than one Lot within the Association, the owner retains the right to use the Association’s facilities so long as his or her additional lots are not also leased.
Each Owner acknowledges, understands and agrees, to inform its tenants, that the Association, its Board of Directors and committees are not insurers of safety and that each Person using the Wildewood facilities assumes all risks of personal injury, death, and loss or damage to property, resulting from acts of third parties. Owners will be held responsible for all damages incurred by any of their renters and/or their guests. All provisions of these Bylaws and any Association rules shall apply to all Owners, occupants, tenants, guests and invitees of any Unit. Any lease on any Unit shall provide that the lessee and all occupants of the leased Unit shall be bound by the terms of these Bylaws, and the rules of the Association.
